Please read these Terms of Service (“Terms”) carefully before accessing or using the geofinder.mobi website and the GEOfinder software application, which is made available through or in connection with the website (collectively referred to as the “Service”). These Terms outline important legal rights and obligations.

By accessing or using the Service, you confirm that you have read, understood, and have the legal capacity to agree to these Terms in full. If you do not agree, please do not use the Service.

The Service is owned and operated by Gray Peach Media Inc., a company registered in the United States (referred to as "GEOfinder", "we", "us", or "our").

For details on how we collect and use personal data in connection with your use of the Service, please refer to our Privacy Notice.

Agreement

This Agreement establishes the complete and legally binding terms between you ("User" or "you") and GEOfinder, encompassing these Terms, our End User License Agreement, Privacy Policy, Refund Policy, Cookie Policy, Compatibility Policy, and any additional operating rules published through the Service. By reference, our Privacy Notice and other applicable policies are integral to this Agreement

This Agreement replaces and nullifies all previous or simultaneous discussions, whether written or spoken, regarding this subject.

When using GEOfinder, you should guarantee and promise that::

  1. You are of legal age in your jurisdiction and legally capable of entering into this Agreement.

  2. You are not subject to any legal restrictions that prevent you from using the Service in your jurisdiction.

  3. You will comply with these Terms and all applicable laws and regulations.

These Terms are subject to modification at any time unless stated otherwise. If any significant changes could impact your use of the Service or alter your legal rights as a user, we will notify you in advance by posting an update on the Service or by sending a notice to the email you provided. It is your responsibility to periodically review the Terms for any updates. Your continued use of the Service after any changes are made signifies your acceptance of those changes.

A printed version of these Terms shall be considered valid evidence in legal or administrative proceedings relating to the use of the Service and will carry the same weight as documents originally created and maintained in physical form.

Account Creation and Registration

To access the full range of features the GEOfinder offers, you must create a personalized account (“Account”) by providing a valid email address. Upon registration, you consent to receive an email with details on accessing your User Space within the Service. You have the option to change your Account password at any time through the User Space.

Your Account is for personal use only, and you may not transfer or assign it to others.
You are entirely responsible for maintaining the confidentiality of your login credentials and for any activity that occurs under your Account, whether authorized or not.

If you wish to delete your Account permanently, you can navigate to the Account settings and select "Delete your account". Please note that once your Account is deleted or suspended, you will no longer be able to access it.

If you suspect that your Account has been accessed without your authorization or if your login credentials have been lost, stolen, or compromised, you must notify us immediately at [email protected] to help secure your Account.

You are responsible for ensuring that your use of the Service and your Account complies with all applicable laws, rules, and regulations.

GEOfinder Services Overview

You may use the GEOfinder Service under the following conditions:

  1. You are a parent or legal guardian using the Service to monitor your minor child.

  2. You are using the Service on a device that you own.

  3. You have secured explicit consent from the device owner to utilize the Service in connection with their phone number.

Please note that GEOfinder does not control, monitor, or verify the purpose for which users utilize the Software. GEOfinder will not be held responsible for any misuse of the Software by users.

License to the software application. GEOfinder reserves the right to modify, add, or remove features and functions of the Software at its sole discretion at any time.

Service updates. To improve the Service, GEOfinder may release updates to the Software periodically. You agree that GEOfinder may update the Software with or without prior notice to you.

Data security. GEOfinder takes the security and integrity of your personal information seriously. All personal data stored in our database is encrypted, meaning GEOfinder does not have direct access to your encrypted data. However, GEOfinder is not responsible for any security breaches, data leaks, or third-party vulnerabilities that may occur in databases or DSN servers. GEOfinder will not be held accountable if there is any breach involving encrypted data.

GEOfinder stores user login details securely in our database. However, we do not store passwords directly – only the hashed version of your password, generated using the Blowfish algorithm.

Subscription Terms and Conditions

Placing an order

When subscribing, you will choose from a single subscription plan. You must complete your billing details and provide payment information during this process. Please note that GEOfinder does not store your payment details – these are securely processed by our third-party payment provider.

Subscription plans

  • GEOfinder offers a 1-month subscription or a 28-day cycle.

  • Each plan allows you to track an unlimited number of phone numbers

  • Your subscription will automatically renew unless you disable auto-renewal at least 24 hours before the plan expires. This can be done within your User Space/Account.

After your purchase, you will receive your login credentials via email, granting you access to your User Space. Once your subscription ends, the service will no longer be available.

Trial period

  • GEOfinder offers a trial for 0.99 USD/EUR/CAD (depending on your billing country).

  • The trial lasts for 24 hours from the moment you place the order.

  • You must enter your billing information to activate the trial.

  • After the trial ends, you will be charged for the Basic plan unless you cancel auto-renewal in your User Space.

You can cancel your subscription at any point during the trial period.

Payment details

  • Payments are processed through PayPal. You agree to PayPal's Terms of Service and Privacy Policy when making a payment.

  • GEOfinder is not responsible for any data handled by PayPal.

  • Currency exchange rates applied by your bank will depend on your local currency, which may differ from the one in which prices are quoted.

Pricing and discounts

  • GEOfinder may update subscription prices at any time and will notify users before the change takes effect. Continued use of the service implies acceptance of the new price.

  • Discounts may be applied at GEOfinder's discretion, and we will determine the frequency and amount.

Refunds and returns

  • GEOfinder offers a money-back guarantee for unsatisfied customers. Eligibility for a refund depends on various factors, including the package type, subscription plan, and time since purchase. For details, please refer to our Refund Policy.

Cancellation

  • You may cancel your subscription and disable automatic renewal at any time through your User Space. To initiate cancellation:

    1. Log in to your account and click the menu in the top right corner.

    2. Select Other from the menu, then choose Subscription.

    3. Review your subscription details and click the option to stop your subscription.

    4. Select the reason for cancellation and provide a brief explanation to activate the Proceed button.

    5. Enter the email address associated with your account to receive a security code.

    6. Enter the code in the designated field and click Submit to confirm cancellation.

  • Once confirmed, your subscription will remain active until its scheduled end date, after which no further charges will be made unless you renew. If you wish to reactivate your subscription at any time, you may do so through your account using the same process.

Certain features of our Service may connect you to third-party services and content we don't control. You may find links to other websites within our service, which are provided to help you explore additional information.

However, we haven't reviewed all the content on these external websites, and we're not responsible for their content or any of the products or services they offer. Content Ownership and Intellectual Property

The Service is owned and operated by GEOfinder. By using the Service, you acknowledge the following:

Content ownership. All materials in the Service, including text, graphics, images, video, sounds, music, computer code, and intellectual property rights (collectively referred to as "Content"), are owned or licensed by GEOfinder or included with permission from the rightful owners. These materials are protected by copyright and other intellectual property laws.

Trademarks. Certain trademarks, logos, and trade names displayed on the Service are owned by GEOfinder or other relevant holders. These may not be used, copied, or imitated without prior written permission from GEOfinder or the applicable trademark holder.

Download restrictions. No ownership rights are transferred to you if you download or copy any Content. You agree not to alter or remove any ownership notices attached to materials downloaded from the Service.

Limited license. GEOfinder grants you a limited, personal, non-exclusive, non-sublicensable, revocable, non-transferable license to:

  • Use the Service on your personal devices as outlined in these Terms.

  • Access and view any available content through the Service that is accessible to you.

Restrictions on use. Without prior written permission from GEOfinder:

  • You cannot frame or imply that a third-party website is endorsing any Content.

  • You may not incorporate GEOfinder's intellectual property into another website or Service.

Requesting permission. If you want to link to the Service from your website, please send your request, including your name, address, website URL, and a site description, to [email protected].

License revocation. GEOfinder reserves the right to alter or revoke your access to the Content at any time, for any reason, without prior notice. This limited license does not waive any of GEOfinder's rights to the Content.

Enforcement of rights. GEOfinder is committed to fully enforcing its intellectual property rights, including legal action if necessary.

Limitation of Liability Terms

You agree to defend, indemnify, and hold harmless GEOfinder and its related parties from any claims, damages, losses, liabilities, costs, or expenses (including attorney fees) arising from:

  • Breach of terms: Any violation by you of these Terms.

  • Use or misuse: Any improper use of the Service or its materials.

  • Violation of law: Any breach of applicable laws or third-party agreements you're subject to.

Additionally, you agree to reimburse GEOfinder for any damages, losses, or costs it incurs, including:

  • Legal fees (attorneys, accountants, and other professional advisors).

  • Expenses related to the defense or settlement of any claims resulting from your unlawful use of the Service.

GEOfinder reserves the right to manage our legal defense as we deem necessary, even when you're indemnifying us. You agree to cooperate with GEOfinder to ensure the successful execution of this strategy.

Governing Law and Jurisdiction

  • Governing law: These Terms are governed by the laws of the United States, excluding its conflict of laws rules.

  • Your rights: These Terms do not limit your rights under local laws.

  • Service restrictions: If using the Service is against the laws of your location, you should not use it. It's your responsibility to know and follow the laws in your jurisdiction.

Dispute Resolution:

  • Negotiation: Any dispute related to the Service or these Terms should first be resolved through amicable negotiations with the GEOfinder team.

  • Court jurisdiction: If negotiations fail, disputes will be settled exclusively in the state courts of the United States, subject to its jurisdiction and laws

  • Time limit: Claims must be made within one (1) year of the issue arising unless a longer period is required by applicable law.

Electronic Communication Terms

By using the Service, you agree that GEOfinder may send you emails or notifications through the Service. These communications may include:

  • Notices about the Service or products you've used or requested.

  • Updates about changes to your account.

  • Information related to transactions you're involved in.

GEOfinder may also use your personal information to send you newsletters, marketing materials, and other Service-related information.

You can opt out of receiving these promotional emails by following the unsubscribe instructions in the emails.

Service Duration and Termination

Termination by GEOfinder:

  • We can modify, suspend, or stop the Service, content, or features at any time, with or without notice.

  • We can offer or cancel opportunities for some or all Service users

  • We are not liable if any of the above changes occur.

  • We may take action, including suspending or terminating your access or account, if we suspect any violations of these Terms.

  • We may work with legal authorities or third parties if any crimes or civil wrongs are suspected.

Termination by you:

You can terminate this agreement anytime by deleting your account and not using the Service.

  • All licenses granted to you will immediately end when you close your account.

  • We will delete all your account and activity data from our servers without liability.

Additional Terms

GEOfinder can transfer these Terms to anyone at any time, with or without your consent. You cannot transfer the Terms to anyone without GEOfinder's permission. If you do, it will not be valid.
